THE TREES must return to their Lands!
07 Aug 2021, 13:06 1.5B İsmail Türkbay İsmail Türkbay July and August 2021 will be recorded as the time when the highest number of forest fires have broken out in the world and in Turkey. Opposition and public opinion; He attributed that there were not enough fire-fighting planes and helicopters, that THK’s fire-fighting planes had not been used for political reasons, and that the necessary measures had not been taken in time. In response to criticism, government officials who were primarily responsible for the wildfires did not accept responsibility, with defenses such as “there was no plane anyway”, “the planes were unusable” , “the burning forest areas were the responsibility of the municipalities”. The essence of the question has been washed away, why was the forest not protected? Were the necessary precautions taken before the fire? Have enough staff been employed? Are the fire routes clear? Have these roads preventing the spread of fire been cleared? Are forest entries and exits under control during the fire season? His questions were not asked, and if they were, they were very few. However, laws, especially the Constitution, have regulated mandatory provisions that protect the forest. For some reason, the provisions of the Constitution and the law were not implemented or were followed. By recalling the importance of the forest, of the Constitution and of the laws, let us recall how the forest will be protected, who will intervene in the event of a fire, and the established rules, generally accepted which must be applied in the process until its extinction. . .. Why are trees and forests important? The forest and the tree are the only factory that produces free oxygen in the air we breathe. It regulates the water cycle, prevents precipitation from floods and landslides, and prevents the region’s temperature from rising or falling. It hosts and protects wildlife. It meets the needs of man with its fruits and wood. These are the ones that immediately come to mind, the benefit of the forest is not limited to what I have mentioned. If I try to list its other advantages, I would have to write many pages, let’s be satisfied with that. One of the general principles of law is the rule that laws cannot be unconstitutional. article 11 of the Constitution; “Constitutional provisions are the basic rules of law which bind legislative, executive and judicial bodies, administrative authorities and other institutions and individuals.
Laws cannot be contrary to the Constitution. He brought his judgment, let’s keep that in mind. Article 169 of the Constitution stipulates by whom and how the forest will be protected, no settlements can be established on the burnt areas, and it will be reforested.
